3 Attend Teen Night in August 2017 at one of our 9 Health & Fitness Centres in the GTA.
  Contest representatives will be available at all Teen Nights in August. Check in with them to let them know you've entered the contest.

THIS CONTEST IS OPEN TO ONTARIO RESIDENTS ONLY AND IS GOVERNED BY CANADIAN LAW

1. CONTEST PERIOD: 

The YMCA of Greater Toronto Youth Membership Contest (the “Contest”) begins on July 31, 2017 at 12:01 am Eastern Time (“ET”) and ends on August 31, 2017 at 11:59 pm ET (the “Contest Period”). By participating in this Contest, you (and, if you are a Minor (defined below), your parent or legal guardian) agree that you have read and understand these Official Rules and Regulations (the “Rules”) and agree to be bound by these Rules.

2. ELIGIBILITY:

The Contest is open only to legal residents of the Greater Toronto Area who are between the ages of thirteen (13) (inclusive) and eighteen (18) (inclusive) at the time of entry, except employees, representatives or agents (and those with whom such persons are domiciled, whether related or not) of YMCA of Greater Toronto, a registered charity (the “Sponsor”), its parent companies, subsidiaries, affiliates, prize suppliers, community centres, advertising/promotion agencies and any other entity involved in the development, production, implementation, administration or fulfillment of the Contest (collectively, the “Contest Parties”).  

NOTE TO MINORS: If you are thirteen (13) years of age or older, but have not yet reached the age of eighteen (18) (a “Minor”) sixteen (16) years of age or older, your parent/legal guardian must agree, on your behalf and on your parent/legal guardian’s own behalf, that both of you will be legally bound by these Rules before you can enter the Contest. The Sponsor reserves the right, in its sole and absolute discretion, on a random audit basis or at any time and for any reason, to contact a Minor’s parent/legal guardian for the purposes of verifying his/her: (i) agreement to be legally bound by these Rules on such Minor’s behalf and on his/her parent/legal guardian’s own behalf; (ii) consent to the Minor’s participation in this Contest; and/or (iii) consent to the collection of the Minor’s personal information.  Failure of a Minor’s parent/legal guardian to complete any such required verification to the complete satisfaction of the Sponsor within the timeline specified by the Sponsor may, in the sole and absolute discretion of the Sponsor, result in the disqualification of such Minor.                                                                                                                                                 

3. HOW TO ENTER: 

No purchase necessary. To enter, an eligible entrant must first go to www.ymcagta.org/teenfitness (the “Website”) and follow the on-screen instructions to obtain, fully complete and submit the Official Contest Entry Form during the Contest Period (the “Entry Form”). Next, an eligible entrant must visit a YMCA Teen Night at a participating YMCA of Greater Toronto (each, a “Teen Night”) (a list of eligible Teen Nights is included in Schedule A) and ask the Sponsor’s representative on-site to submit his/her Entry Form into the Contest (an “Entry”). To be eligible, an Entry must be submitted and received in accordance with these Rules during the Contest Period (as determined by the Sponsor in its sole and absolute discretion).  The Releasees (defined below) will be in no way responsible in the event that a Teen Night is delayed, cancelled, postponed or rescheduled for any reason whatsoever.

4. LIMITS:

There is a limit of one (1) Entry per person/email address per Teen Night during the Contest Period. For greater certainty and the avoidance of any doubt, you can only use one (1) email address to enter the Contest.  If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor) that any person has attempted to: (i) exceed any of the limits stated in the Rules; and/or (ii) use multiple names, identities, email addresses and/or any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or to disrupt this Contest; then he/she may be disqualified from the Contest in the sole and absolute discretion of the Sponsor.  Your Entry may be rejected if (in the sole and absolute discretion of the Sponsor) it is not fully completed with all required information and submitted and received in accordance with these Rules during the Contest Period.  The Releasees (defined below) are not responsible for late, lost, misdirected, delayed, incomplete, illegible or incompatible Entries (all of which are void).    

5. VERIFICATION:

All entrants and Entries are subject to verification at any time and for any reason.  The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification): (i) for the purposes of verifying an individual’s eligibility to participate in this Contest; (ii) for the purposes of verifying the eligibility and/or legitimacy of any Entry or other information entered (or purportedly entered) for the purposes of this Contest; and/or (iii) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with these Rules.  Failure to provide such proof to the complete satisfaction of the Sponsor within the timeline specified by the Sponsor may result in disqualification in the sole and absolute discretion of the Sponsor.  The sole determinant of the time for the purposes of this Contest will be the Contest server machine(s).

6. THE PRIZES:

There will be fifty (50) prizes (the “Prizes”) available to be won. Each Prize consists of a one-year health and fitness membership at a YMCA of Greater Toronto Health and Fitness Centre, which must be redeemed at a YMCA of Greater Toronto Health and Fitness Centre on or before September 30, 2017 at 11:59 pm ET. Participating YMCA of Greater Toronto Health and Fitness Centres include: Toronto Sheppard Avenue YMCA, Oshawa Mary St. YMCA, Toronto Scarborough Town Centre Crt. YMCA, Toronto Central Grosvenor St. YMCA, Brampton Union St. YMCA, Mississauga Burnhamthorpe Rd. YMCA, Toronto West End College St. YMCA, Markham YMCA Blvd. Rudy Bratty YMCA, Cooper Koo Family Cherry St. YMCA. The one-year health and fitness membership is subject to all YMCA membership terms and conditions available at https://ymcagta.org/health-and-fitness/membership/member-etiquette-and-usage. Each Prize has an approximate retail value of $468 CAD.

Without limiting the foregoing, the following terms and conditions apply to the Prizes: a) the Prizes must be accepted as awarded and are not transferable, assignable or convertible to cash (except as may be specifically permitted by Sponsor in its sole and absolute discretion); b) no substitutions except at Sponsor’s option; c) Sponsor reserves the right, in its sole and absolute discretion, to substitute any Prize or a component thereof with a prize of equal or greater retail value, including, without limitation, but at Sponsor’s sole and absolute discretion, a cash award; d) all characteristics and features of the Prizes (except as otherwise explicitly stated above) are at the Sponsor’s sole and absolute discretion; and e) all costs not expressly stated above as included in a Prize are the applicable winner’s sole responsibility.

7. SELECTION OF WINNERS:

There will be one (1) random draw that will take place on September 1, 2017  (the “Draw Date”) in Toronto, ON, between 9:00 am ET and 5:00pm ET from among all eligible Entries received during the Contest Period.  The first fifty (50) entrants selected in the course of the random draw will each be deemed a potential Prize winner.  The odds of winning a Prize depend on the number of eligible Entries received in accordance with these Rules during the Contest Period.

8. NOTIFICATION AND CONFIRMATION:

The Sponsor or its designated representative will make a minimum of three (3) attempts to contact each potential Prize winner (by email using the information provided at the time of entry) within three (3) business days of the Draw Date.  If a potential Prize winner cannot be contacted within three (3) business days of the Draw Date, or if there is a return of any notification as undeliverable; then he/she may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to a Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to randomly select an alternate potential Prize winner from among the remaining eligible Entries (in which case the foregoing provisions of this section shall apply to such new potential Prize winner). 

Before being declared A CONFIRMED PRIZE winner, each potential Prize winner will be required to: (a) correctly answer a mathematical skill-testing question without mechanical or other aid; and (b) sign (and, if a Minor, his/her parent or legal guardian will also have to sign) and return within five (5) business days of notification the Sponsor’s declaration and release form, which (among other things): (i) confirms compliance with these Rules; (ii) acknowledges acceptance of a Prize as awarded; (iii) releases the Contest Parties and each of their respective officers, directors, agents, representatives, successors and assigns (collectively, the “Releases”) from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the applicable Prize or any portion thereof; and (iv) agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner whatsoever, including print, broadcast or the internet.  If a potential Prize winner: (a) fails to correctly answer the skill-testing question; (b) fails to return the properly executed Contest documents within the specified time;  (c) cannot accept (or is unwilling to accept) a Prize (as awarded) for any reason; and/or (d) is determined to be in violation of these Rules (all as determined by the Sponsor in its sole and absolute discretion); then he/she may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to a Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to randomly select an alternate potential Prize winner from among the remaining eligible Entries (in which case the foregoing provisions of this section shall apply to such new potential Prize winner).   

9.             GENERAL CONDITIONS:

 

All Entries become the property of the Sponsor. This Contest is subject to all applicable federal, provincial and municipal laws.  The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of Entries and/or entrants.

 

Each entrant (and, if a Minor, his/her parent or legal guardian) agrees that the Releases will not be liable for: (i) any technical malfunction or other problems relating to the Website or computer networks, on-line systems, servers, access providers, computer equipment or software; (ii) the failure of any Entry to be received for any reason, including, but not limited to, technical problems or traffic congestion on the Internet or at any website or any disruption of a Teen Night; (iii) any injury or damage to an entrant’s or any other person’s computer or other device related to or resulting from participating in the Contest; and/or (iv) any combination of the above.

 

In the event of a dispute regarding who submitted an Entry, the Sponsor reserves the right, in its sole and absolute discretion, to deem the Entry to have been submitted by the authorized account holder of the email address submitted at the time of entry.  “Authorized account holder” is defined as the person who is assigned an email address by an internet provider, online service provider, or other organization (e.g. business, educational institute, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. An entrant may be required to provide proof (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification) that he/she is the authorized account holder of the email address associated with the Entry in question.

 

The Sponsor reserves the right, at its sole discretion, to amend or suspend this Contest (or to amend these Rules) in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules.  Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest in any way (as determined by Sponsor in its sole and absolute discretion) is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law.  The Sponsor, at its sole and absolute discretion, reserves the right to cancel, amend or suspend this Contest, or to amend these Rules, in any way without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason whatsoever.  Without limiting the generality of the forgoing, the Sponsor reserves the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate based on the circumstances and/or to comply with applicable law.

 

By entering this Contest, each entrant (and, if a Minor, his/her parent or legal guardian) consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted at the time of entry for the purpose of administering the Contest and in accordance with the Sponsor’s privacy policy (available at: ymcagta.org/privacy). This section does not limit any other consent(s) that an individual may provide the Sponsor or others in relation to the collection, use and/or disclosure of their personal information.

The Sponsor reserves the right, at its sole discretion, to adjust any of the dates and/or timeframes stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any entrant or Entry with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason.

 

In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to: any website and/or point of sale, television, print or online advertising; the terms and conditions of these Rules shall prevail, govern and control to the fullest extent permitted by applicable law.
